NEWSCHANNEL 9’S CUTEST KID 2012 CONTEST RULES
Who Can Enter
1. To be eligible to participate in this contest, entrants must be 18 years of age or older and reside in the WTVC viewing area, consisting of the following counties: Bledsoe, Bradley, Grundy, Hamilton, Marion, McMinn, Meigs, Polk, Rhea, and Sequatchie, Tennessee; Catoosa, Chattooga, Dade, Fannin, Murray, Walker, and Whitfield, Georgia; Jackson, Alabama; and Cherokee, North Carolina. Photos of kids submitted must be ages 6 and under.
2. Employees of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Sinclair Television of Nashville, Inc., and any other company which owns, programs or provides other services to television broadcast station WTVC (the “Station”), The Douglas Group, Inc. dba UPICKEM, Rhea Lana’s Consignment Sale and Sir Goony’s (“Sponsor”), their affiliated companies, advertising and promotion agencies, any and all local television broadcast and cable stations, local radio and other media companies, and the immediate family members of each are ineligible. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren. Only one winner per household.
How to Enter
(a)No purchase is necessary to enter. Only one entry per contestant.
(b)To enter, log on to www.newschannel9.com and click on the NewsChannel 9’s Cutest Kid Contest contest button. Fill out the online Upickem entry form with your name, address, age and phone, then upload a photo depicting YOUR CUTEST KID 6 years of age and under. Station reserves the right to accept or deny photo entries based on content. No mechanically reproduced or completed entries will be accepted. No incomplete entries will be accepted.
(c)By entering, entrants represent and warrant (i) that he/she owns the photograph submitted, (ii) it does not violate the rights of any third parties, (iii) the picture is of the entrant’s child, (iv) the picture has not been altered or enhanced with any software (excluding redeye), and (v) he/she agrees to the terms and conditions located at http://www.newschannel9.com/station/legal/terms.shtml. No lewd, nude, or offensive photographs (as determined by the Station in its sole and absolute discretion) will be accepted. The Station reserves the right in its sole and absolute discretion to disqualify any entry.
(d) The contest starts on Sunday April 1, 2012 at 12:01 AM EDT and ends at 11:59 p.m. EDT on April 30, 2012 (the “Contest Period”). Entries must be received by Station by 11:59 p.m. EDT by April 22, 2012 to qualify for the voting period. No submissions will be accepted outside of the above times.Station is not responsible for lost, late, or misdirected entries, or for printing errors, server unavailability, computer or any other electronic malfunction.
(e) Between April 23, 2012 and 11:59 p.m. EDT on April 30, 2012, viewers will be asked to vote online for his/her favorite picture. Voting is limited to one vote per IP address per hour. Duplicate votes will be disqualified. The Station reserves the right to determine in its sole and absolute discretion whether the online votes are valid, and may disqualify any duplicate votes. Multiple and/or irregular votes from the same user or users, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or other source will be considered invalid.
(f) On May 4, 2012, the ten (10) pictures with the most votes will then be judged by a panel of judges comprised of Station personnel based on content (25%), creativity (25%), and cuteness (50%). The judges will determine one winner based on the criterion described above. The decisions of the judges shall be final.
(g) All entries (including pictures) received that are mutilated, tampered with, incorrect, illegible, or from ineligible entrants will be void. All entries (including pictures) become the property of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc. and the Station and will not be acknowledged or returned.
The Prize(s)
1. One (1) winner will receive a $150 Visa Gift Card from Rhea Lana’s Consignment Sale, and a Super Birthday Party from Sir Goony’s for 2 hours for up to 11 children, valued at $149.00., The total prize value is $299.
2. Winners will be notified by email. Winners must sign and return a release and affidavit of eligibility, which must be received within five (5) days of notification. Winners must show picture identification to claim prizes. Station reserves the right to examine additional identification and may choose to accept or deny awarding the prize based on the identification presented.
3. If a winner cannot be notified within five (5) days, or does not timely return the affidavit of eligibility, then the prize will be forfeited, and the prize will awarded to an alternate winner with the next highest number of votes, as determined by the Station judges in their sole and absolute discretion.
4. There will be no substitutions or cash alternatives for prizes except at the sole discretion of Station. The Station has the right to substitute a prize of similar value. No transfer or assignment of prizes is allowed.
5. The winner is responsible for paying all local, county, state and federal taxes on prizes based on the estimated retail value of the prizes as set forth in these rules.
6. Winners are required to complete and return a W-9 form.
7. Only one prize will be awarded per household. Contestants are eligible to win only one prize within any 30 day period, regardless of the number of contests entered.
8. Sinclair Television of Nashville, Inc., LLC, Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. are not liable if the provider of any part of the prize fails to satisfy its obligations to furnish its portion of the prize.
9. Sinclair Television of Nashville, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. are not responsible for any liabilities arising directly or indirectly from the award or use of the prize.
10. In claiming your prize, you acknowledge that Sinclair Television of Nashville, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. have the right to publicize your name, character, likeness, photograph, voice and the fact that you are the winner for promotional purposes without financial remuneration.
Odds of Winning/Miscellaneous
1. Odds of winning depend on the number of entries and votes received.
2. Complete contest rules are available Monday through Friday during normal business hours at WTVC, 4279 Benton Drive, Chattanooga, TN 37406 or on the Station’s website at www.NewsChannel9.com
3. For a list of prize winners, send a separate, self-addressed, stamped envelope to WTVC 4279 Benton Drive, Chattanooga, TN 37406 by May 31, 2012.
4. This contest is subject to all applicable laws and regulations and is void where prohibited. Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Sinclair Television of Nashville, Inc., The Douglas Group, Inc., and Rhea Lana’s Consignment Sale and Sir Goony’s accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession or use of any prize awarded hereunder.
5. Station cannot be held liable for any lost or stolen entries, prizes or contest information.
6. Station reserves the right to make rules and contest changes and change the aforementioned contest dates.
UPICKEM RULES
No purchase necessary. One valid entry per contestant.
You must be 13 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.
Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If NewsChannel9 cannot find an eligible winner for the prize, that prize will not be awarded.
Odds of winning depend on the number of eligible entries received.
Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided.
Only one registered account per voter. If multiple accounts are detected for a single voter, they will be disabled and votes disqualified.
NewsChannel9 reserves the right to substitute any prize with another prize of equal or greater value.
NewsChannel9 reserves the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of NewsChannel9, its respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to NewsChannel9 the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
NewsChannel9 reserves the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, and/or NewsChannel9. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and NewsChannel9 are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
